Daniel Waddington

Daniel Waddington is a former police officer and a former Department of Homeland Security employee. Until recently, he was a Utah Valley University adjunct professor of Criminal Justice. On August 3, 2023, he was arrested for attempted sexual exploitation of a minor and possession of Child Sexual Abuse Material. He was filming a 13-year-old girl in the shower. She saw the phone and informed an adult. He, at first, said he just set the phone down while checking on a barking dog, then he said he was trying to record her singing – audio only.

The girl’s father took his phone and laptop and saw his had Child Sexual Abuse Material. Her parents took them to the police who found about 300 pieces of Child Sexual Abuse Material. They found several nude pictures of the girl he was filming and film of another, much younger girl. They even found his attempt to film up the skirts of his college students. In the end, they found 8000 pieces of Child Sexual Abuse Material plus 8000 pieces where the age was unclear.

Waddington had more access to children than most. He served on the Board and was an active volunteer with Second Chance 4 Youth, a program to provide opportunities for at-risk youth. The KSL article below is full of details.

I believe there is probable cause to charge the defendant with these charges because:
In July of 2023, American Fork police officers received a report of a sexual offense that occurred on July 11, 2023, at a residence
in American Fork City.
The adult complainant reported that Daniel Waddington had attempted to video record a 13-year-old female, over which
Waddington maintained a position of trust, in a bathroom taking a shower. Waddington had attempted to do this by propping his
cell phone up against a wall and recording the 13-year-old female through a crack in the door. The 13-year-old female observed
this and subsequently reported it to the complainant.
The day after the incident the 13-year-old female told the complainant Waddington had approached her saying he was simply
trying to get an audio recording of her singing in the shower.
The complainant told investigators that he subsequently while in his den he located Waddington’s laptop and found it to be
unlocked and open. The complainant reported he observed what appeared to be images and videos of child abuse sexual
material (CSAM.) The complainant reported he confronted Waddington with these images and videos to which Waddington
admitted he had a “problem” with this, referring to what the complainant called child pornography.
The complainant brought Waddington’s phone and laptop, as well as a USB drive belonging to Waddington, to the police
department during their initial complaint - officers did not request this. The complainant turned these items over to investigators.
Investigators obtained a search warrant for these three items and all three items were forensically processed. As a result of this,
investigators recovered at least 300 images and/or videos of what appear to contain child abuse sexual material (CSAM) in that
many of the images involve what appeared to be pre-pubescent children.
Investigators also recovered images of the 13-year-old victim with no clothes on in the bathroom. It appears Waddington had
video-recorded the victim but then deleted the video upon getting caught. Only images were able to be recovered from the
phone through processing rather than video.
It is of note that for approximately 6 years, Waddington worked as an adjunct professor for a local university. One of the images
recovered from forensic processing was a photo taken in what appears to be a classroom at this university. The photo is shooting
up a female’s dress/skirt. Although the picture does not display any nudity, the photograph violates what a reasonable
expectation of privacy would be for an individual wearing a dress or a skirt
From forensic processing, investigators also located at least one image taken on July 10, 2023, at an unknown swimming pool
location of an unknown female that appears to be approximately 10 years old. One of the recovered photos is a close-up photo of
this female child’s crotch and buttocks while she is sitting against a wall with her knees pulled up.
On 08/03/2023, investigators worked with an attorney who had been retained by Waddington to have Waddington turn himself in
at the police department, which he did. Waddington refused to submit to an interview without his attorney present. Waddington
was subsequently arrested and transported to the Utah County Jail.
One of the proposed charges is aggravated sexual exploitation of a minor due to the fact Waddington produced child sexual
abuse material by video-recording the victim while she was nude without her knowing.
We believe that Waddington should be held in pretrial detention without bail for the following reasons.
First, Waddington is a retired law enforcement officer for the Long Beach City Police Department in Long Beach, California, and is
believed to have been an officer for over 25 years. Waddington also has extensive graduate education in criminal justice-related
fields. Also, Waddington claims to have over 40 years of domestic and international criminal justice experience. With this work
and educational experience, Waddington would know how serious these offenses are and may be more likely to flee and/or
engage in other activities that may hinder the investigation and ongoing prosecution.
Second, Waddington told investigators he worked for the United States Department of State until June of 2023. Waddington
traveled often and his LinkedIn biography indicates he has engaged in extensive law enforcement training, consulting, and
training in at least 8 other countries across Europe, South Africa, Asia, and Africa. Based on his international contacts and travel
experience, it would be easier for him than a reasonable person to flee outside of the United States to numerous different
locations.
Third, Waddington has access to youth and children through a significant amount of avenues. One of these is his sitting on the
board of directors for Second Chance 4 Youth, a program to provide opportunities and positive trajectories for at-risk youth and
those in the juvenile justice system. We believe that if Waddington were to be released, he would continue to have ample access
to children and youth. We have already demonstrated through this probable cause statement his willingness to take advantage of
unknowing children and/or teenagers
Waddington does not have any criminal history in the State of Utah. He is not currently on probation or parole.
