Brian Chisholm and his fellow Maryland state legislator Sid Saab owned a gym together. An employee who had worked for them for thirteen years reported that she was sexually harassed for two years by one of their managers. Rather than investigate her complaint, they fired her. She sued them for retaliation. They tried to get the case dismissed, claiming they fired her for timekeeping issues, but the court ruled a reasonable factfinder would see their reason for firing as a pretext, while the real reason was retaliation for suing.
